These Website Terms of Service (“Terms”) govern your access to and use of our website, landing pages, forms, and related online services (collectively, the “Site”). By accessing or using the Site, you agree to these Terms.
1. What the Site Is (and Isn’t)
1.1 Sales and informational funnel. The Site is intended to provide information about our services and to allow prospective clients to request information, schedule a call, or apply/sign up for services.
1.2 Client services are governed by a separate agreement. If you become a client, your purchase and use of Dovetail services are governed by a separate written agreement (our “Master Service Agreement” or “MSA,” plus any statements of work (“SOWs”) and order forms). If there is a conflict between these Terms and the MSA regarding services, the MSA controls.
1.3 No guarantee of outcomes. We do not guarantee results, including (without limitation) closings, signed contracts, commissions, revenue, or ROI. Any examples are illustrative only.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Site.
3. Privacy
Your use of the Site is also subject to our Privacy Policy (including our SMS/text messaging disclosures).
4. Using the Site
4.1 Permitted use. You may use the Site only for lawful purposes and in accordance with these Terms.
4.2 Prohibited use. You agree you will not:
Attempt to gain unauthorized access to the Site or related systems.
Interfere with or disrupt the Site (including by introducing malware).
Scrape, crawl, or harvest data from the Site in an unauthorized manner.
Use the Site to send unlawful, misleading, or abusive communications.
Use the Site in a way that violates any applicable laws, rules, or regulations.
5. Forms, Submissions, and Leads
5.1 Accurate information. If you submit information through our forms (e.g., name, email, phone, business info), you represent that it is accurate and that you have the right to provide it.
5.2 No confidential submissions. Do not submit sensitive personal information (e.g., SSNs, financial account numbers, medical info) through Site forms. Submissions via the Site are not intended to be confidential unless we expressly agree in writing.
6. No Accounts (Currently)
The Site does not currently offer user accounts or logins. If we add accounts later, additional terms may apply.
7. SMS/Text Messaging Terms
If you opt in to receive SMS/text messages from us, the terms in this section apply.
7.1 Opt-in and consent. By providing your mobile number and checking the consent checkbox on our form, you consent to receive text messages from Dovetail Collective. Messages may include:
Operational/service messages (e.g., scheduling, reminders, onboarding, service updates), and/or
Marketing messages (e.g., promotions, offers, service announcements)
7.2 Message frequency. Message frequency may vary.
7.3 Costs. Message and data rates may apply depending on your mobile plan.
7.4 Opt-out. You can opt out at any time by replying STOP to any message we send. After you opt out, you may receive a final confirmation message, and we will stop sending further texts (except where permitted by law).
7.5 Help. You can reply HELP for assistance or email us at [email protected].
7.6 No sale of mobile number. We do not sell or share your mobile number or SMS opt-in information for third-party marketing.
7.7 Consent not required. Your consent to receive SMS messages is not a condition of purchase.
7.8 Delivery disclaimer. Message delivery is not guaranteed and may be affected by carrier/device/network factors outside our control.
7.9 Automated technology. We may send messages using automated technology.
7.10 Privacy. See our Privacy Policy for details on how we handle personal information.
8. Intellectual Property; Site License
8.1 Our content. The Site and its content (including text, graphics, logos, videos, templates offered for preview, and design) are owned by or licensed to Dovetail and are protected by intellectual property laws.
8.2 Limited license. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your internal business purposes in accordance with these Terms.
8.3 No copying or redistribution. Except as expressly permitted in writing, you may not copy, modify, distribute, sell, or create derivative works from Site content.
9. Testimonials and Reviews (Current and Future)
9.1 Optional future reviews. We may add features that allow reviews, testimonials, or other user-generated content.
9.2 If you submit a review. If we enable reviews and you submit content, you agree:
Your submission is truthful and not misleading;
You won’t post confidential information, personal data of others, or unlawful content; and
You grant Dovetail a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and publish the review/testimonial for marketing and operational purposes (unless you revoke consent in writing where applicable).
10. Third-Party Links and Tools
The Site may link to third-party websites or tools (e.g., scheduling software, analytics, CRM tools). We do not control those third parties and are not responsible for their content, policies, or practices.
11. Fair Housing and Advertising Compliance Reminder
Because we serve real estate professionals, advertising and marketing content may be subject to fair housing rules, MLS/brokerage rules, and platform policies.
11.1 No discriminatory content. You agree not to request, submit, or direct us to create or publish advertising or content that is discriminatory, excludes protected classes, or otherwise violates applicable fair housing or advertising rules.
11.2 Client responsibility for approvals and compliance. If you become a client under an MSA/SOW, you are responsible for ensuring your marketing claims, offers, and content (including images, copy, targeting, and disclaimers) comply with applicable rules and any broker/MLS requirements, including any required approvals.
11.3 Right to refuse or remove content. We may refuse to publish, pause, or remove content or campaigns that we believe (in our reasonable judgment) could violate applicable rules or platform policies.
12. DMCA / Copyright Notice
12.1 Copyright concerns. If you believe any content on the Site infringes your copyright, you may request removal by submitting a notice.
12.2 How to submit a takedown notice. Email [email protected] with the subject line “DMCA Notice” and include:
Identification of the copyrighted work you claim has been infringed;
Identification of the material you claim is infringing, including the specific URL(s) on our Site;
Your name, address, telephone number, and email address;
A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law; and
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf; and
Your physical or electronic signature (typing your full legal name is generally acceptable).
12.3 Counter-notice. If you believe content was removed or disabled by mistake or misidentification, you may submit a counter-notice to [email protected] with the subject line “DMCA Counter-Notice” and include:
Identification of the material that was removed/disabled and where it appeared before removal (URL if available);
A statement, under penalty of perjury, that you have a good-faith belief the material was removed due to mistake or misidentification;
Your name, address, telephone number, and email address; and
A statement that you consent to the jurisdiction of the appropriate court for your location (or, if outside the U.S., an appropriate U.S. jurisdiction) and that you will accept service of process from the party who submitted the original notice (or their agent), plus your physical or electronic signature.
12.4 Repeat infringers. Where appropriate and in our discretion, we may disable or terminate access for users who are repeat infringers.
13. Disclaimers
13.1 Site provided “as is.” The Site is provided on an “as is” and “as available” basis. We make no warranties or representations that the Site will be uninterrupted, error-free, or secure.
13.2 No professional advice. The Site content is for general informational purposes and does not constitute legal, financial, or other professional advice.
13.3 No guarantee of results. Any references to outcomes, timelines, or examples are not guarantees. Marketing performance depends on many factors outside our control.
14. Limitation of Liability
To the maximum extent permitted by law, Dovetail will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Site.
To the maximum extent permitted by law, Dovetail’s total liability for claims related to the Site will not exceed $100.
(If you are a paying client, your MSA may contain different liability terms that apply to service-related claims; those terms control for services.)
15. Indemnification
You agree to defend, indemnify, and hold harmless Dovetail and its owners, officers, directors, employees, and contractors from and against claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site in violation of these Terms, (b) information you submit through the Site, or (c) your violation of any law or third-party right.
16. Dispute Resolution (Website)
16.1 Good-faith conference first. If a dispute arises out of or relating to the Site or these Terms, the parties will first confer in good faith to try to resolve it.
16.2 Mediation in Marion County, Indiana. If not resolved, the dispute will proceed to non-binding mediation in Marion County, Indiana.
16.3 Binding arbitration (AAA) in Marion County, Indiana. If still not resolved, the dispute will be submitted to binding arbitration administered by the American Arbitration Association (AAA) in Marion County, Indiana, before a single arbitrator, under applicable AAA rules.
16.4 Costs. Each party will bear its own fees and costs for the dispute process, unless the arbitrator awards otherwise under applicable rules.
16.5 Injunctive relief for confidentiality/IP. Either party may seek temporary injunctive relief in Indiana courts to protect confidential information or intellectual property while arbitration is pending.
16.6 Venue for court applications; service. For court applications related to injunctive relief or arbitration enforcement, venue and jurisdiction lie exclusively in the state or federal courts located in Marion County, Indiana, and service may be made by certified mail or nationally recognized courier to the last known address provided by a party.
16.7 MSA controls for clients. If you are a Dovetail client under an MSA/SOW, the dispute resolution provisions in your MSA/SOW govern service-related disputes.
17. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict of laws principles.
18. Changes to the Site or Terms
We may modify the Site or these Terms at any time. Changes are effective when posted with a new Effective Date. Your continued use of the Site after changes means you accept the updated Terms.
19. Termination
We may suspend or terminate access to the Site at any time if we believe you violated these Terms or if needed to protect the Site, users, or our business.
20. General Terms
20.1 Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
20.2 No waiver. Our failure to enforce any provision is not a waiver.
20.3 Entire agreement for Site use. These Terms (together with the Privacy Policy) are the entire agreement regarding your use of the Site, and do not replace your MSA for services.
20.4 Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
